AviMate Warranty

The following is the limited warranty portion of the Warranty and License Agreement which clients are presented prior to using AviMate:

"LIMITED WARRANTY. Boundaries Unlimited (BU) warrants that the SOFTWARE is free from defects in material and workmanship and will so remain for 90 days from the date of receipt. BU will replace defective media or documentation at no charge, provided you return the item with dated proof of payment to BU. If BU is unable to replace defective media or documentation, BU will refund the license fee. These are your sole remedies for any breach of warranty. Except as specifically provided above, BU makes no warranty or representation, either express or implied, with respect to this SOFTWARE or documentation, including its quality, performance, merchantability, or fitness for a particular purpose."

"BECAUSE SOFTWARE IS INHERENTLY COMPLEX AND MAY NOT BE COMPLETELY FREE OF ERRORS, YOU ARE ADVISED TO VERIFY YOUR WORK. IN NO EVENT WILL BU BE LIABLE FOR DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE OR DOCUMENTATION, EVEN IF BU IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN PARTICULAR, BU IS NOT RESPONSIBLE FOR ANY COSTS INCLUDING, BUT NOT LIMITED TO, THOSE INCURRED AS A RESULT OF LOST INFORMATION OR DATA, LOST PROFITS OR REVENUE, BUSINESS INTERRUPTION, LOSS OF USE OF SOFTWARE, THE COST OF RECOVERING SUCH SOFTWARE OR DATA, THE COST OF SUBSTITUTE SOFTWARE, CLAIMS BY THIRD PARTIES, OR OTHER PECUNIARY LOSSES. IN NO CASE SHALL BU'S LIABILITY EXCEED THE AMOUNT OF THE LICENSE FEE."

"The warranty and remedies set forth above are exclusive and in lieu of all others, oral or written, express or implied. No BU dealer, distributor, agent, or employee is authorized to make any modification or addition to this warranty. Some states or countries do not allow exclusions or limitation of implied warranties or limitation of liability for incidental or consequential damages. For such cases, the above limitation or exclusion may not apply to you. If a part of this Agreement shall be determined by a court to be invalid, illegal or unenforceable, the remaining provisions shall in no way be affected or impaired thereby."
